The Town of Berkshire held their regular town meeting on June 15th, 2009 in the board room of
the town hall.

The meeting was called to order at 7:03 PM by Supervisor Simmons, He opened with the Pledge
of Allegiance
.

Members present: Supervisor Mike Simmons, John Stoughton, Lillian Hoffrnier, Fraser
Williams, Ronald Hartwig. Also present Highway Superintendent Karl Spoonhower.

Approval of the minutes- John Stoughton made a motion to accept the May minutes seconded by
Ronald Hartwig, and carried.

Privilege of the floor- Linda Gardner asked about the property tax figures. The budget is
reflecting more tax revenue than there should be
. Ronald Hartwig is going to follow up on this
issue. Mrs. Gardner also asked about the health insurance bu
y out line DA9060.4. The new
contract included a cap on this and it looks as though that was not caught. Mr. Hartwig will

check with the book keeper and make the corrections needed.           .

Karl Spoonhower also asked what budget line the payroll was coming out of. This will also be
checked.

Reports:

A. County Planning Board- James Lacey- Jim wasn't in town to attend the county planning
board meeting.

B. Code enforcement- Lee Virtue-Absent-(Lee is out of town, Has Newark Valley covering

for him).

C.   Clerks Report- passed

D.  Justice Court- Absent

E.Highway Report- Karl Spoonhower- Going to start working on the roof at the garage later
this week
. Employees hired for this job are going to be- Chance Spoonhower, Eddie Carter, Karl
Spoonhower
, and George Decker. They will be working as regular town employees.

F. Planning Board- James Lacey (Joe Palmari absent)- Satisfied with gas drilling resolution.

Happy with code enforcement document. Discussed ATV law again.

G.  Dog Control- Ron Raab- Absent.

H.Assessor report- passed- Board of review will be filing there determinations with her on
June 18th. She is working on a six year plan to keep the town at a 100
% assessment.

I. Supervisor Report- Michael Simmons- Annual insurance is done. 810.00 dollars is to be
paid to the town in three installments for an investment made a few years ago. Street lights- pole
numbers have been given to Tom Standard 2 on Mill St. and 1 on Railroad Ave. He will give them

to the engineers.

Old Business:

1.  Dog enumeration- working on it.

2.  Street lights- covered under Supervisors report.

3.Fire Station! community center status-vote on June 30th from 6:00-9:00 pm

4.  Grievance day- done

5.  Web site update- Fraser Williams trying very hard to update. Wants to put minutes on as soon

                                                                                                       as possible.           ..

6. Sidewalk Grant- David Young will have a copy of the draft next week.

New Business:

We would like to create budget lines for the news letter- revenues A1255.1, expenses A1220.1.
A motion was made by Fraser Williams to add these lines and seconded by Ronald Hartwig and
carried.

Donation requests from BCA to purchase paint and supplies for the community hall. The History
Buffs will be using the community hall during Heritage day
. Would like the building to look
nice. $4000.00 is the figure they came up with to do the job. Ronald Hartwig made a motion to
donate 400.00 to the BCA. Seconded by Michael Simmons, and carried.

Highway Capitol Reserve Fund- Resolution #8 (attached) A motion to approve was made by
Lillian Hoffmier seconded by Fraser Williams and carried.

Gas Drilling- Resolution # 9 (attached) A motion to approve was made by Michael Simmons
seconded by John Stoughton and carried.

Board concerns: Swartwood! Brame legal issue nothing as yet.

Warrants: John Stoughton made a motion to pay the general as audited #80-94 totaling 25,865.52
seconded by Ronald Hartwig and carried. Ronald Hartwig made a motion to pay the highway
warrant as audited #74-88 totaling 97,638.01 seconded by Michael Simmons and carried.

A motion to adjourn at 8:09 PM made by Ronald Hartwig seconded by Fraser Williams and
carried.
