The Town Board of the Town of Berkshire held their monthly meeting in the Town Hall on December 14, 2004. Meeting called to order at 7:00 PM by Supervisor Hartwig.
Board members present were-- Dennis Whittaker, Albert Warner, Jr., John Ceurter, and Trudy Bentley. Absent was Karl Spoonhower, Sup’t of Hwys.
Correction to the minutes of November—Change General Warrant total to read $3,432.18 took Voucher #73 off.) Highway Warrant total to read $5,508.72 (Add #155 and delete #151--was already paid) Dennis Whittaker makes the following changes under” New Business “# D”. Change the word agreement to read proposal through the paragraph. “ #E.” corrects the fact that John Ceurter made the motion not the appointment seconded by Trudy not Trucy. Seconded by Trudy Bentley. Carried.
Privilege of the Floor—No comments.
Communications and Petitions
1. Planning Board Minutes from Sept. were passed and left for filing. (They owe Oct. minutes). 2. Assoc. Of Towns Letter—The State was trying to withhold the Town’s Share of Speeding Tickets, but they are not going to. We will be receiving them as usual.
Reports
A. County Planning Board—George Swaney—absent. B. Highway Dept.—Karl Spoonhower—absent. C. Code Enforcement—Joe Ceurter read and left his report to be filed. D. Planning Board—George Swaney—absent. E. Town Clerk—passed report. F. Dog Control—Albert Warner, Jr.—Dog Kennels will soon be available in Newark Valley on 38B ready in Oct. 2005. G. Committee reports—nothing to report. H. Supervisor—passed cash flow and the budget is looking good. No changes in CD so no report. Justice report passed and filed with Supervisor. Settled with Haefele TV now have high speed internet. E-Mails from Mrs. McEwen to Supevisor about holding un-advertised meetings on Thursday evenings before regular Board Meeting. They are in our organizional meeting, not violating “open meetings law.” Also, about Mr. Ousby and the Howland Bros. Clean up. Not in favor of the Howland Bros. Purchase. Town out of it--dead issue. Not sure who is the owner.
Old Business
1. Resolution—Board Meeting and Warrant Procedure Change presented by Supervisor each Board member received one. Dennis Whittaker seconded by Trudy Bentely made motion to accept resolution. Carried. 2. County Planning Board Appointment—George Swaney terms expires and he doesn’t wish to run again. Charles Dowdell is interested. Motion to appoint Mr. Dowdell to the County Planning Board was made by Supervisor Hartwig, seconded by Trudy Bentley. Carried. A recommend from the County Planning Board to replace George will be coming.
New Business
A. Road Presevation Local Law Draft—Presented to board by Supervisor Hartwig.

B. NYS Retirement—Earned Credits— don’t have on file a list of elected officials, Auditor says that we should have one. Supervisor read off how these credits were arrived at. Trudy Bentley seconded by John Ceurter to have Supervisor file this list. Carried. C. Berkshire Representative—REAP Board—Dennis Whittaker’s term is up at end of year. Supervisor Hartwig appoints Dennis Whittaker to another term seconded by Trudy Bentley. Carried. D. Attorney for the Town—will replace Kirk Martin of Owego with Richford’s lawyer. Mr. Steven Krna 692-3235. Motion made by Trudy Bentley, Seconded by John Ceurter to make the appointment and to discharge Mr. Kirk Martin. Carried E. Howland Mill St. Property—dead issue—Not sure who owns this? F. Budget Reconciliation Meeting Date—“End of Year” meeting will be held on December 30, 2004 at 7:00 PM. Advertise in the Courier.

Highway Warrant #156 & 157 $1094.88 General Warrant #76 – 91 $3009.08 Motion to pay as audited was made by Trudy Bentley, seconded by Dennis Whittaker. Carried
Motion by John Ceurter, seconded by Trudy Bentley to adjourn at 7:43 PM. Carried.
