The Town Board of the Town of Berkshire held their Organizational Meeting in the Town Hall on January 17, 2006. Supervisor Hoffmier led the Pledge of allegiance. Board members present were Dennis Whittaker, Albert Warner, Jr., Trudy Bentley and Audrey Payne Supervisor Hoffmier passed the Organizational meeting agenda to the board. The only modification over last year was the Thursday work session was changed from 4:30 PM to 5: PM Motion to approve the Organizational Meeting as presented was made by Trudy Bentley, seconded by Dennis Whittaker. 5 ayes 0 noes. Carried. Motion to adjourn the Organizational Meeting at 7:02 PM was made by Dennis Whittaker, seconded by Trudy Bentley. Carried.
Regular Meeting:
Regular meeting called to order at 7:02 PM by Supervisor Hoffmier, with all board members present. County Legislator--Dick Harrington—The County has appointed Don Burns to chair the new legislator board for the present Mr. Burns will be the County Manager until they appoint one, or not appoint one. Mr Harrington will remain on the same committees as last year. Rehab on the Court House is under way should be done by the end of the year. No chicken farm in Nichols, are moving on to another county for this. County in control of voting machines but N Y S has not selecteded a universal style as yet. Privilege of the Floor—Ray Hunt tells of the grant received by the Historians of Newark Valley, Richford, and Berkshire --they got 50% of what was asked for. This is to restore old pictures. And they are looking for a picture of Doc. Hartnagel. Ronald Hartwig –Congratulations to the new board and the Supervisor.
Communications and Petitions: Nothing.
Reports: 1. County Planning Board—absent 2. Highway Dept--absent 3. Code Enforcement—Joe read and passed his report or filing. Is going to talk to George Decker about the rumor of a “Transfer Station” on Howland Bros. Property. 4. Planning Board—Jim Lacey—Planning Board doesn’t meet each month. No one showed for the Nov. Meeting. Communication between the Town Board and the Planning Board. Minor changes to the existing Junk Law. Have Town Board look at and see if they have any changes. Copies will be handed to Board with Joe’s changes. 5. Town Clerk –passed report. 6. Dog Control—Albert took 3 dogs to Stray Haven 7. Committee reports—the Supervisor passed a new listing of the committees and who is on them. 8. Supervisor Hoffmier passed the CD listing, cash flow report to be viewed and filed. Also the Court report was passed.
Old Business:
David Weber of P O Box 126 79 Main St. Candor has agreed to serve as the “Attorney of the Town” of Berkshire At the rate of $150.00/hour. His phone number is 659-7583. Motion by Trudy Bentley, seconded by Audrey Payne to have Dennis Whittaker notify Mr. Weber of his appointment New Business:

A. Budget Amendment—Retirement Bill add General A9010 $4384 t o total $5884. Add Highway DA9010$4100 to total $8000. These are from fund balance.
B. Speed limit—set at 35 mph on town streets table until next meeting C. EMS Contract—Nothing finalized as yet. Copies sent to Richford and Newark Valley. D. Collateral Source Bill—Limits Town Liability—Double dipping—only get whats awarded. Show our support to Senator Libous. Letter read, Motion to send letter was made by Trudy Bentley, Seconded by Albert Warner, Jr. 5 ayes 0 Noes Carried. E. Committee Assignments—was coverd under Supervisor report.
Warrants: General Fund #1 - #3 -#13 $6256.69 (#2 voided.) Highway Fund #1 - #12 $9250.19 (voucher #10 reduced down to $809.30 Question on NAPA Slip. Motion to pays as audited was made by Albert Warner, Jr., /seconded by Trudy Bentley. 5 ayes 0 Noes Carried.
