The Town of Berkshire held their Organizational Meeting on January 18, 2005 in the Town Hall.                            

Meeting called to Order at 7:00 PM by Supervisor Hartwig.

 

Board members present were: Dennis Whittaker, Albert Warner, Jr., John Ceurter and Trudy Bentley. Also present was Karl Spoonhower Sup’t of Hwys.

 

The meeting was opened with the Pledge of Alligience.

 

Supervisor Hartwig presented the Organization Meeting as follows:

 

A.      Resolved; the rules of Procedure for the conduct of Board Meetings for the Town of Berkshire shall remain as they were in 2004.

B.       Resolved; Each member of the Town  Board and all elected officials currently serving their respective

       Terms of office remain electors of the Town of Berkshire.

C.       Resolved: All elected town officers reaffirm their oaths of office if required. The Official Undertaking

        Requirements of State Law shall be fulfilled by existing insurance portfolio.

D.      Resolved the following appointments are made or verified:

E.       Resolved:  The Town of Berkshire approves the salaries of election workers to be $.50 per hour above the minimum wage, and the chairman will receive $1.00 above the ninimum wage.

F.       Resloved:  Town Officers, appointed and elected shall be compensated in the same manner as 2004, in the amounts specified in the approved 2005 Town Budget:

G.       Resolved: The regular Berkshire Town Board Meetings for 2005 will be held on the 3rd Tuesdy  of each month at 7:00 PM in the Town Hall.

H.      Resolved:  Town Board Workshops Meetings will be held on the Thursday peceeding the monthly Board meeting at 4:30 PM in the Town Hall.

I.         Resolved:  The Official Newspaper for the Town of Berkshire shall be the “Tioga  County Courier.”

J.        Resolved:  The official depository of the “Town of Berkshire shall be the National Bank and Trust Co. of Norwich at the Newark Valley branch.

K.      Resolved:  The Supervisor is authozed to file the NYS Comptrollers Annual Update Document with the Town Clerk in lieu of an Annual Report.

L.       Resolved:  The Berkshire Town Clerk may impose a fine of $15.00 for any check returned by reason of insuficent funds.

M.     Resolved:  The Town Supervisor is authorized to purchase insurance commensurate with the Towns needs for 2005/2006.  Such costs are not to exceed appropriated amounts designed in the Adopted Budget for 2005.

N.      Resolved:  The Town Board reaffirms its support for all existing Town Laws, Ordinances, Policies and

Codes.

O.      Resolved:  Travel policies  for Town Officials will be in accordance with the Travel and Voucher   

       Reimbursement Policy dated 1/18/2005.

 

Supervisor Hartwig says that Item E.  The election inspector pay was raised back in the summer—This is a higher rate and will supercede the one set last summer.

Motion to accept the Organizational Meeting was made by Trudy Bentley, seconded by Albert Warner, Jr.  Carried.

Motion to adjourn the Organizational Meeting at 7:05 PM. was made by John Ceurter, seconded by Trudy Ceurter. Carried.

 

Regualr Meeting

 

Regular Meeting called to order at 7:05 by Supervisor Hartwig.  All members present.

 

Approval of December 30, 2004 minutes was made by Dennis Whittaker, seconded by Trudy Bentley. Carried.

 

County Legislator absent.

 

Privilege of the floor—no comments

 

                                                Communications and Petitions

 

A.      Work Plus Program-January 24 – by Cornell Cooperative Extension

B.       County Planning Board—March 16-2005 at 7:30 PM in Berkshire.

C.       Cornell Cooperative Extension will hold an open house on the Work Plus Progrm Jan. 24

                                                Reports

 

1.        County  Planning Board-C Dowdell –absent

2.        Highway-Karl Spoonhower-Almost out of sand, lots of cinders.

3.        Code-Joe Ceurter-passed report for filing tells about the county doing septic work etc.

4.        Town Clerk-passed report and a $100,000.00 check to the Supervisor towards the Tax Collection Process

5.        Dog Control-Al Warner, Jr.—Ongoing complaints from neighbors about animals being outside.

6.        Committee reports: nothing to report.

7.        Town Justice: Report passed and left to be filed.

8.        Supervisor: CD rate going up slowly, Passed Cash recipts log to be filed, Final End of Year Statement—better than thought—General under by $10,000., Highway under by $20,000.

Highway had a lighter payroll, repairs made in garage not taken out. Over spent on roads becaause of higher oil prices.  Put into reserve for next year.

 

 

                                                Old Business

 

A.      2004 Fund Balance $223,261.37 and FEMA money  to come.

B.       Road Preservation Local Law draft—made some changes—will do next meeting.

Sec. #4.1—Who keeps Work Sheets?  Highway Sup’t.?

Highway Sup’t to approve or disapprove and decide to have a bond. Limits set by Town Board.  Bond held by Town Board.

 

 

New Business

 

1.        Highway Equipmnt Inventory—Copy was given to Clerk for files.

2.        Travel Policy Resolution:  Passed as presented motion was made by Trudy Bentley, seconded by John Ceurter.  Carried.

3.        Transfer Funds to Highway:

 

Warrants

 

General Fund #1-14 $11,582.21 (deleted voucher #3 Paid on Dec. Warrant).

 

 Highway Fund #1-13 $10,984.82

 

Motion to pay as audited was made by Trudy Bentley seconded by Dennis Whittaker.  Carried.

 

Motion to Adjourn at 7:55PM was made by John Ceurter, seconded by Trudy Bentley.  Carried
