The Town Board of theTown of Berkshire held a public hearing on July 19, 2005 at 6:30 PM in the Town Hall.
Board Members present were: Dennis Whittaker, Albert Warner, Jr., John Ceurter, and Trudy Bentley. Also present was Karl Spoonhower, Sup’t of Hwys.
Meeting called to Order at 6:30 by Supervisor Hartwig—Purpose of the public hearing was hear pros and cons of this law and to discusss the purchase of a new truck for the Highway Dept.
ATV Law: Club is active and other towns like our law and want copies of it. Only Town roads are the Topic of discussion. Northern Tioga Riders—Map of lands, segments of roads to be used copies of insurance and membership with the state of New York are attached to this law.
Purchasing a new truck: Karl has specs from two companies with very close specs. State bid is with Sterling. Would like to spec this out and put it out for bid and hope to get a better price and exactly what he wants for a new truck. Supervisor to work on this with Karl and get it typed up and ready to the news paper.
Supervisor Hartwig Seconded by John Ceurter made motion to adjourn at 7:00 PM. Carried.

The regular meeting of the Town Board followed the public hearing with all members present.
The meeting was opened with the pledge of allegiance.
Trudy Bentley seconded by Albert Waner, Jr, made approval of the June 21, 2005 minutes. Carried.
County Legislator—Dick Harrington—absent
Privilege of the Floor—Richard Odom presented the completed inventory of the Highway Dept. A copy is on file with the Town Clerk.
Communications and Petitions
A. FEMA Approval Notice—From the April 1st & 2nd Storm we will get $4400.00. No check as yet
Reports
1. Co. Planning Board—absent 2. Highway Dep’t. —Karl—Got Ballou Hill oiled and stoned. Should be ready for shoulder work. Working on seasonal roads Ceurter and Turkey Hill done. Also County won’ t have the bridge repaired on Glen Road for 2 years. Stop signs are in the way and create a hazzard. Need to formally write a letter to the county and then notify our Legislator of this hazzaard. 3. Code Enforcement—Joe read report and left it to be filed. 4. 5. Town Clerk—Passed report 6. Dog Control— Albert Warner, Jr-- nothing to report. 7. Committee Reports—John Ceurter and Richard Odom have completed the Town Sheds Inventory and the Truck history. A copy was given to the Supervisor and the Town Clerk for filing. Trudy working on the Collector audit. 8. Supervisor –passed the cash flow report and the updated CD listing. States that NBT Newark Valley still offers the best interest for the Town so far. Insurance settelment of $45,000.00 minus the deductable of $500.00 and the truck. Court night is 1st and 3rd Monday at 7:00 PM.
Old Business:
A. ATV Local draft was discussed at the Public Hearing and no one objected to this becoming a law. Trudy Bentley made the motion seconded by Albert Warner, Jr. to accept this law. Roll Call Vote: Whittaker-aye, Warner-aye, Ceurter-aye, Bentley-aye, and Hartwig –aye 5 Ayes. 0 Noes. Carried. B. Vacancies on Planning Board and the Board of Review—No one has asked to be on either board at this time.
New Business
1. Variance Request—John Beebe has been told he needed a 150-ft. road frontage to sell—Not true. Code Enfrocement Officer is to write a letter explaining this to John’s lawyer. There is no law in Berkshire to not allow this sale. Variance Request—Bonnie Hutchings—asked for a variance to erect a garage closer to the propertry line than the building code allows. John Ceurter made the motion to grant this variance to Mrs. Hutchings seconded by Trudy Bentley. 5 Ayes, Noes. Carried. 2. Procurement Policy—A few changes are being made to our present policy and will be ready for the next meeting. 3. Fire Dept. Equipment replacement public meeting held on July 20, 2005 @ 7:00 PM. 4. Town Road Signs—Supervisor would like to see all Town road signs straight and marked. Cleans up the Town. 5. Complaint on Brame Property at 39 Railroad Ave. Need to check with Justice to see if any outstanding tickets or warrants are open on t his.

Motion to pay as audited was made by Trudy Bentley, seconded by Albert Warner, Jr. Carried.
Motion to adjourn at 7:50 PM was made by John Ceurter and seconded by Dennis Whittaker. Carried.
