The public hearing was held on March 9, 2004 in the Town Hall. Supervisor Hartwig called meeting to order at 6:45 PM.
Members present were: Dennis Whittaker, Albert Warner, Jr., John Ceurter, and Trudy Bentley. Also present was Karl Spoonhower Sup’t of Hwys.
Representative from Haefele TV was Office manager Denise.
Copies of the new Franchise were left to be signed and notarized
No interested people appeared to be heard for or against this franchise.
Motion made to adjourn the public hearing by John Ceurter at 7: 00 PM, seconded by Trudy Bentley. Carried.
Regular Meeting
Supervisor Hartwig opened the regular meeting of the Town Board at 7:00 PM with the Pledge of Allegiance. All board members were in attendance.
Also, item 5-- strike the word whom and replace it with who. Approval of the minutes as corrected was made by Dennis Whittaker, Seconded by Trudy Bentley.
Privilege of the Floor:
George Hoffmier asks about Liability coverage of leased equipment that may be sabotaged, Who furnishes parts and fuel, Supervisor says that the equipment that is sabotaged is covered by town insurance. Parts and fuel are contractor responsibility. Irv Hand asks what hours are the highwaymen working? Hours are 6: – 2:30 PM. or whatever hours the Sup’t requires.
COMMUNICATIONS AND PETITIONS:
A. County Planning Board Meeting on March 17, 2004 at 7;30 PM in the Town Hall. B. Planning Board Minutes of Feb. 9 were passed and left to be filed. C. Grant Writing Seminar will be held in Owego.
REPORTS:
1. Co. Planning Board—George Swaney –two business in Owego are expanding, one on Marshland Rd. And one in the village. 2. Highway Dept—Karl-- not doing too much just working on the garage and the court room. 3. Code Enforcement—Joe read report and left it to be filed. 4. 5. Town Clerk passed report and turned in to the County checks totaling $180,00. 6. Justice –A Report was filed with the Supervisor. 7. Dog Control—no report 8. Committed reports—Trudy has the Justice audit done, the bookkeeper will be next. Highway—nothing yet. 9. Supervisor—passed Cash Flow and CD list. Has gone to a municipality savings account to earn a bit more interest than the CD’s are.
OLD BUSINESS:
A. Haefele TV franchise Resolution—Copy passed from Supervisor. Dennis Whittaker made the motion to authorize the Supervisor to sign this and return to Lee Haefele. Seconded by Trudy Bentley. 5 ayes, 0 noes. Carried. B. Lawn mowing bid: mowing of the ballfield, 4 cemeteries, and around the Town Hall. Bids received from------Mike Albrecht; ballfield $40., Town Hall, Brown Rd., East Berkshire and Methodist cemeteries $20. Each, Rawson Hollow cemetery $25. Joel Payne-----Brown Rd. cemetery $100., East Berkshire cemetery and Methodist cemetery $75.00 each, Ball field and area around Town Hall $100.00. Jordan Lilley-----Cemeteries—Brown Rd. $45., Rawson Hollow $35., East Berkshire $35. Methodist $40. Ball fields $60., around Town Hall $$30. C. The Berkshire Rookies------Ballfield and around Town Hall $590.
Dennis Whittaker said the Lawn mowing bid should go to the lowest bidder. Trudy Bentley made the motion to award the bid to Mike Albrecht, seconded by John Ceurter. 5 ayes, 0 noes. Carried. D. Terry Vanderpool—cancelled his insurance policy in October, therefore it nullifies the contract on the removal of the Coal Building. Supervisor to make contact with Vanderpool. Co. Legislator—Dick Harrington—Left Tioga Co. Calendar of Events for 2004 for anyone interested. Howland Bros.—HUD people had the buildings appraised. Closing Talcott St Bridge 0n 3-15, bridge on Day Hollow Rd./Gaskill Rd. will be worked on. And the Brown Rd.(North end )will be replaced. Resurfacing of Wilson Creek Rd. this summer. New salt storage at Co. Hwy. Dept. Dental Van will be at N V Middle School. Call Susan Mudina at 687-8595, she is the interface between Social Services and the School. 3000’ needed to accommodate the Courtroom in Owego.
3. Roller Bid: a. 5-Star Equipment—1999 used Sakai 835 hours $41,200. b. Beck Equipment---1999 used Superpac 924 hours $46,400. c. Beck Equipment---1997 Superpac 1807 hours $41,400. d. Beck Equipment---1999 Hypac 1416 hours $39,800. e. Bradco Supply---1998 Ammann 1560 hours $38,500. The bids were gone over but Sup’t hadn’t seen the roll at Bradco Supply and wanted to see it. The Bid awarding will be tabled until April 13, 2004 meeting. Trudy Bentley, seconded by John Ceurter made this motion. 5 ayes, 0 noes. Carried
4. Equipment bid: a. George Hoffmier No trucking fee, insurance policy included Excavator with operator $50.00/hour Dozer with operator $40.00/hour Backhoe with operator $40.00/hour

Backhoe with operator $70.00/hour d. Karl R. Spoonhower—no charge for moving equipment, no insurance policy was included Excavator $60.00/hour Dozer--$40.00/hour Backhoe--$40.00/ hour
Karl J. Spoonhower said bids were without operator.
f. Bradco Supply Co.—no delivery charges and without operator if rented for a week or more. Town will be responsible for providing their own insurance. Dozer $250.00/day, $1000./week, $3,000/month Backhoe $225./day, $900./week, $2700//month Dennis Whittaker made the motion to let the bid to George Hoffmier for hourly work with the Excavator, dozer and backhoe. Bradco Supply for the dozer on a weekly or daily or monthly basis. Karl to make decision on his needs. Seconded by Albert Warner Jr. 5 ayes, 0 noes. Carried.
NEW BUSINESS:
A. Site Plan Review Local Law—presented to the Town Board by the Supervisor, requires town board Approval on certain building size, location, etc. looking for tentative approval. Advertise for a public hearing on this for April 13, 2004 at 6:45 PM. Motion by Dennis Whittaker seconded by John Ceurter to accept the Site Plan Review and hold a public hearing. Carried. B. Letter from Burt Siemens Attorney for the Town resigning. His recommendation was Kirk O. Martin from the office of Turk, Truman, Bishop and Tillapaugh. Martin is NV’s ADA. Charges $95.00/hour. Bills town once a year. Looked at Richford’s attorney. Tillapaugh’s group will be having a satellite office in Newark Valley. Mundt has retired. Motion to hire Kirk O. Martin was made by Trudy Bentley, seconded by Albert Warner Jr. 5 ayes, 0 noes. Carried. C. Eagle Scout Project—Mike Albrecht seeks approval of a Project for Eagle Scout Qualification— Is seeking to take charge of the Rawson Hollow Cemetery on Brummage Rd. This needs a lot of work. Mike will organize this project and take charge of organizing labor and work parties with his fellow scouts. Asking the Town to furnish fill dirt, seed and mulch as needed. Will remove old stumps, large stones etc. Adults will be asked to operate machinery when necessary. Trudy Bentley seconded by Albert Warner, Jr. granted his request. 5 ayes, 0 noes, Carried.
WARRANTS:
General Fund #11-#19 $338.78, Bookkeeper $73005.22, Highway #26-#41 $8244.93 Motion to approve the warrants as audited was made by Trudy Bentley, seconded by John Ceurter. Carried
