The regular meeting of the Town of Berkshire Town Board was held on May 17, 2005 in the Town Hall.
Supervisor Hartwig called the meeting to order at 7:00 PM opening with the Pledge of Allegiance. Members present were--Dennis Whittaker, Albert Warner, Jr., John Ceurter and Trudy Bentley. Absent was Karl Spoonhower Sup’t. of Hwys.
Approval of April Minutes: Dennis Whittaker and Supervisor Hartwig want their names to appear under Reports item D along with the rest of the Board Members. Motion to accept the minutes with this change was made by Dennis Whittaker, Seconded by John Ceurter. Carried.
County Legislator—absent.
Insurance Report—Don Patterson—absent
Privilege of the Floor—no comments.
Communications and Petitions
A. Letter on Road Preservation Law—Assemblyman Finch was called about our losing CHIPS Monies as was dicussed at the April Meeting couldn’t find anything concerning it. No possible conflict at this point. B. Lawyer checked the law before sending it to the State and was in order.
Reports
1. County Planning Board—C.Dowdell absent 2. Highway Supt.-K Spoonhower—absent 3. Code Enforcement—J. Ceurter—read and left his report for filing. Also Handling the 911# system 4. Planning Board—J Lacey—absent 5. Town Clerk—Passed her report. 6. Dog Control—Al Warner—No report 7. Committee reports—John Ceurter and Dick Odom are working on the insurance policy coming up. For renewal. Trudy Bentley—nothing to report. 8. Supervisor- Passed updated CD list. And Cash Flow report. Received a check from Insurance in the amount of $25,000. Someone at NYMIR handled this case that wasn’t supposed to. Nothing settled as yet. (This is concerning the truck that was wrecked.) Does look as though it will be settled in our favor. Gary Finch – was in town for a meeting and 13 people showed. A Thank You is due Dick Odom for buying shrubs and finishing off the flag area. Looks nice. Greivance Day—will be 5-27-05 from 4 to 8 PM. At Council of Gov’t meeting – introduced Community Alert Network—Sign up for it. Paperwork on file 3 people to activate this. Supervisor, Deputy Supervisor, and Fire Chief Can be used for emergency purposes. Motion to approve town membership was made by Dennis Whittaker, seconded by Trudy Bentley. Carried.
Old Business
A. ATV Local Law—Draft was sent to lawyer for approval. Possible to hold a public hearing in July.

1. Speedsville Ballfield Improvements—Thank you for the Town Support from Dave Pitcher. George Hoffmier furnished topsoil. Would like the Highway to help with equipment. Motion to offer in kind support to Speedsville Ballfield was made by Trudy Bentley, seconded by Albert Warner, Jr. Carried. 2. Funds for Wacky Weeders—Looking for funds to help keep the entrance to the Town on 38 north and South looking good. ( Not the Library) Supervisor felt that $200.00 could be found for this. Motion to find funds for the Wacky Weeders was made by Supervisor Hartwig, seconded by John Ceurter. Carried. 3. Fee Schedule-- A New schedule has been made to reflect the Road Preservation Charges. Motion to accept the New Fees Schedule was made by Dennis Whitttaker seconded by Trudy Bent ley. Carried. Effective May 17, 2005. 4. Credit Unions-- are looking for legislators to allow municipalities to join, interest rates are higher. Still illegal for us to join. Supervisor to write to legislators in favor of. Motion by Trudy Bentley, seconded by Dennis Whittaker. Carried.
Approval of Warrants
General Fund #60 -#76 $3,119.37 Highway Fund #60-#74 (Holding #72 Citgo for more gas slips), $24,996.83
Motion to pay as audited was made by Dennis Whittaker seconded by Trudy Bentley. Carried
Motion to adjourn at 8:00 PM was made by John Ceurter seconded by Albert Warner, Jr. Carried
